Bill Name: Expiration Date Act of 2007
Bill Description: An Act regulating the imprinting of expiration dates on perishable consumer products.

Be it enacted by the Senate and the House of Representatives of the United States in Congress assembled:

SECTION 1: TITLE
This act shall be known as the "Expiration Date Act of 2007"

SECTION 2: DEFINITION OF TERMS
For the purpose of this Act, the following terms shall be defined as follows:
a.) Expiration Date - It refers to the date in which a food, medicinal, hygienic, and household products are expected to perish and be considered unfit for use.
b.) Food product - It refers to any edible product that has been processed for public consumption.
c.) Household product - It refers to any non-edible product intended for the sanitation of any man-made habitation, public establishment, or working establishment, as well the sanitation of specific man-made objects, that has been processed for public consumption.
d.) Hygienic product - It refers to any non-edible product intended for the purposes of beauty and cleanliness that has been processed for public consumption.
e.) Manufacturing date - It refers to the date in which a product has been manufactured in its entirety.
f.) Medicinal product - It refers to any edible or non-edible product intended as a cure or remedy for a specific disease or ailment that has been processed for public consumption.
g.) Perishable consumer product - It referes to any edible or non-edible products that are available in the market and are set to perish at a given time and may significantly affect the public health.

SECTION 3: BACKGROUND

WHEREAS, it is widely known that food and medicinal products are perishable products that can significantly affect the public health

WHEREAS, hygienic products can be considered as perishable products due to its chemical nature, and that it can significantly affect the public health

WHEREAS, household products can be considered as perishable due to its chemical nature, and that contact with any object that has been applied with the said product can significantly affect the public health

WHEREAS, many food, medicine, hygienic, and household products do not have an expiration date imprinted on it, or has not been imprinted legibly for a common man to read

SECTION 4: CREATION OF AN EXPIRATION DATE REGULATORY COMMISSION IN THE DEPARTMENT OF HEALTH AND HUMAN SERVICES; GOALS

An Expiration Date Regulatory Commission shall be created from the Department of Commerce.

The goals of the commission shall be as follows:

(1) Regulate the imprinting of expiration dates in all perishable consumer products manufactured in the United States

(2) Serve as a complaint desk for any individual who wishes to file a complaint against the manufacturers of a product that has failed to provide a legible imprint of its expiration date.

(3) Shall coordinate with the Department of Health and Human Services in investigating such complaints

SECTION 4: POLICIES ON EXPIRATION DATES

Furthermore, the following policies shall be implemented and be regulated by the commission in order to address the problem of illegible expiration date imprints

(1) All perishable consumer products, including food, medicinal, hygienic, and household products, must have an expiration date imprinted in its container.

(2) The expiration date may be imprinted in any part of the container as long as it does not affect the quality of the said product.

(3) The expiration date should include the month and the year in which it is due to perish. The day of expiration is not necessary but encouraged.

(4) A manufacturing date is not compulsory but it is highly encouraged.

(5) A manufacturer may opt to specify the number of months or years that a product is due to perish, so as long as it specifies the manufacturing date. The absence of a manufacturing date shall be considered an offense.

(6) Expiration dates must be imprinted with color. The color must be in contrast with the background of the text to make it more readable. Stamped colorless imprints will not be allowed.

(7) Failure to comply with the abovementioned policies shall be punished as follows:

a. First offense - $200,000 in damages and a 5-year sentence for the personnel in charge of printing the expiration date. The manufacturer may also be convicted if evidence links him to the act.

b. Second offense - $500,000 in damages, 8-year sentence for the personnel in charge of printing the expiration date, and suspension of the permit of the said company by order of the commission.

SECTION 5: SEPARABILITY CLAUSE

If any part of this act is considered unconstitutional, the remaining portion of the act shall remain valid.

SECTION 6: REPEALING CLAUSE

Any previous legislation that is inconsistent with the provision of this act is hereby repealed.

SECTION 7: EFFECTIVITY

The Act shall take effect six (6) months or 180 days after its approval and twenty (20) days after its publication in at least two (2) state newspapers.
