Bill Description: A BILL

To authorize and request the President to award the Medal of Honor to Ross A. McGinnis, of Knox, Pennsylvania, for acts of valor on December 4, 2006, in Baghdad, Iraq, while serving in the 1st Infantry Division.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1.
Authorization and request for award of MEDAL OF HONOR to Ross A. McGinnis, of Knox, Pennsylvania for acts of valor on December 4, 2006.

(a) Authorization- The President is authorized and requested to award the Medal of Honor under section 3741 of title 10, United States Code, to Ross A. McGinnis, of Knox, Pennsylvania , for the acts of valor described in subsection (b).

(b) Action Described- The acts of valor referred to in subsection (a) are the actions of Specialist Ross Andrew McGinnis, being conspicuous act of gallantry at the risk of his life above and beyond the call of duty, December 4, 2006, in Baghdad, Iraq, while assigned to the 1st Battalion, 26th Infantry Regiment, 2nd Brigade Combat Team, 1st Infantry Division.

On December 4, 2006, while on duty in Baghdad, Iraq, McGinnis was manning the gunner’s hatch of his vehicle when an insurgent tossed a grenade from above. The grenade flew past McGinnis and down through the hatch before lodging near the radio. McGinnis used his body to smother a grenade, saving the lives of four fellow soldiers. McGinnis, aged 19, died from the blast.

McGinnis could have escaped the blast, Sergeant First Class Cedric Thomas said. “He had time to jump out of the truck,” he said. “He chose not to. He gave his life to save his crew and his Platoon Sergeant. He’s a hero.”

(c) Waiver of Time Limitations- The award under subsection (a) may be made without regard to the time limitations specified in section 3744(b) of title 10, United States Code, or any other time limitation with respect to the awarding of certain medals to persons who served in the Army.
