Bill Name: Marijuana Legalization Act of 2008
Bill Description: A bill To legalize and tax marijuana, and allow it be be sold to persons aged 18 and older.

Be it enacted by the United States Senate and House of Representatives assembled,

SECTION 1. SHORT TITLE

This Act may be cited as the "Marijuana Legalization Act of 2008".

SECTION 2. PURPOSE

It shall be the purpose of this Act to amend Title 21 United States Code to allow the taxation, production, distribution, and consumption of Marijuana for individuals aged 18 years of age and older.

SECTION 3. REPEALS

The following provisions are repealed: Subsection a(10) and a(17) under 'Schedule I' of Section 112 of Title 21 United States Code.

SECTION 4. AMENDMENTS

Section 112 Title 21 United States Code is amended by adding Schedule VI underneath the paragraph under Schedule V which shall state (The drugs 'Marihuana' and 'Tetrahydrocannabinols' in any form(s) and in any amount(s) shall be prohibited by individuals under 18 years of age. Marijuana not prohibited must be sold only to those 18 years of age or older)

SECTION 5. REGULATION

(a) Persons and/or businesses distributing marijuana for purchase shall only produce marijuana cigarettes which shall contain no more than .015 ounces per marijuana cigarette.

(b) Purchases of less than twenty marijuana cigarettes shall be prohibited. Any purchase of more than forty marijuana cigarettes shall be prohibited.

(c) Persons and/or businesses distributing marijuana for purchase must purchase a license for One Thousand United States Dollars per year which shall be administered by the United States Department of Health and Human Services and enforced by The Bureau of Alcohol, Tobacco, Firearms, and Explosives.

(d) Non-purchased marijuana shall be strictly prohibited and enforced by The Bureau of Alcohol, Tobacco, Firearms, and Explosives.

SECTION 6. TAXATION

A tax of Four United States Dollars per .03 ounces shall be enforced by The Bureau of Alcohol, Tobacco, Firearms, and Explosives and administered by The Department of The Treasury.

SECTION 7. FUNDING

Two Hundred and Fifty Million United States Dollars shall be allocated to The Bureau of Alcohol, Tobacco, Firearms, and Explosives.

SECTION 8. DEFINITIONS

The term 'Marijuana cigarette' means any rolled paper which is meant to be burned and inhaled which contains the substance 'marijuana'.

SECTION 9. ENACTMENT

This bill shall become law upon the passage.
